01. INTRODUCTION

Czech Time (Tomáš Ptáčník, IČ 027 42 667) (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website CzechTime.cz, including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”). Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please leave the site.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Site, and you waive the right to receive specific notice of each such change or modification.

Personal Data

While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. 10. INTERNATIONAL TRANSFER

Our servers are located in the Czech Republic. If you are accessing our Sites from outside the Czech Republic, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information in other countries .

If you are a resident in the European Economic Area, then these countries may not have data protection or other laws as comprehensive as those in your country. European Commission’s Standard Contractual Clauses

Such measures implementing the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers, which require all such recipients to protect personal information that they process from the EEA in accordance with European data protection laws. We have implemented similar appropriate safeguards with our third party service providers and partners and further details can be provided upon request.

10. DATA PROCESSING ADDENDUM (“DPA”)

Processing personal data in a secure, fair, and transparent way is extremely important to us. As part of this effort, we process personal data in accordance with the EU’s General Data Protection Regulation (“GDPR”), the laws of the Russia governing the handling of various types of personal data, and industry standards, such as PCI DSS.

To better protect individuals’ personal data, we are providing these terms to govern our and your handling of personal data (the “Data Processing Amendment” or “DPA”). This DPA amends and supplements your Terms of Use and requires no further action on your part.

If you do not agree to this DPA, you may discontinue the use of the Site’s service and cancel your account.

To comply with the EU’s General Data Protection Regulation (“GDPR”), we adhere to those outlined in the GDPR. Other parts of this Privacy Policy also refer to and apply to DPA related rules and obligations.

“The Site” “we”, “us”, or “our” refers to the owners of the CzechTime.cz website and services, (collectively referred to as “the Site”).

“User” or “You” or “Customer” refers to the customer or user that signs up to use the Site.

“Party” refers to the Site and/or the Customer depending on the context.

Personal Data Protection Policies

  • Each party agrees that personal data shall be treated as confidential information under this DPA.
  • Personally identifiable information shall remain the property of the disclosing party.We recognise that User is the controller and maintains control over personal data.
  • We will process User’s personal data only to the extent strictly necessary for the purpose of providing the services in accordance with our Terms of Service and any further written instructions from the customer that are mutually agreed upon.
  • We will:
  1. Implement and maintain a reasonable and appropriate security program comprising adequate security, technical and organisational measures to protect against unauthorised, unlawful or accidental processing, use, erasure, loss or destruction of, or damage to, customer personal data.
  2. Only allow give access to customer personal data to employees, contractors, and vendors on a “need-to-know” basis to the extent necessary to perform its obligations under the Terms of Use.
  3. Only process customer personal data to the extent necessary to perform its obligations under the Terms of Use, upon written instructions of the customer (only as mutually agreed upon), and in accordance with applicable laws.
  4. Upon termination of your account, we will delete, destroy, or anonymise the personal data in accordance with our standard backup and retention policy per the Terms of Use. This process shall occur within 60 days. If we are required to retain personal data due to the Czech Republic laws, then we reserves the right to retain personal data.

Information Breaches and Incidents

  1. When either party becomes aware of an incident that impacts the processing of personal data, it shall promptly notify the other. Parties agree that they shall reasonably cooperate in order to enable the other party to perform an investigation, craft a response, and to take necessary steps in regards to the incident.
  2. Any notifications made under this section shall be made to the contacts indicated below. Please include a description of the nature of the incident, the name and contact details of the point of contact where more information can be obtained, a description of the incident; and measures taken or proposed to be taken to address the incident.

Liability and Indemnity

Each party indemnifies the other and holds them harmless against all claims, actions, third party claims, losses, damages and expenses incurred by the indemnified party and arising directly or indirectly out of or in connection with a breach of this DPA.
